General Access Terms

In the event the Applicant is issued Fuel Access Cards by Napa Valley Petroleum, the Applicant hereby acknowledges and agrees to be bound by all terms and conditions set forth in NVP Fuel Services’ Fuel Access Card Agreement, which is incorporated herein by reference as though fully set forth herein.

Should the Applicant utilize their account to charge the purchase of fuel, products, equipment, or services, the Applicant agrees to remit full payment for all such charges in accordance with the following terms:

• Payment Terms: Net thirty (30) days from the date of each invoice.
• Late Payment Charges: A service charge of two percent (2%) per month shall be assessed on all past due balances.

In the event that Napa Valley Petroleum deems it necessary to initiate collection proceedings or any other legal enforcement actions to recover outstanding amounts due, the Applicant agrees to be liable for all costs and expenses incurred by NVP Fuel Services in connection with such efforts. These costs include, but are not limited to, collection agency fees, expert witness fees, court costs, and reasonable attorneys’ fees, whether incurred before or after judgment.

The Applicant further agrees that the exclusive venue for any legal action arising out of or relating to the enforcement or collection of this Agreement shall be in the County of Napa, State of California.
