NAPA VALLEY PETROLEUM, INC. ("NVP") agrees to provide automated fueling services to the individual or business ("Customer") named on the issued Fuel Access Card or associated account. By using the Fuel Access Card, Customer agrees to the fueling terms detailed below and accepts full responsibility for all transactions authorized or permitted through their issued Fuel Access Card(s).
FUEL ACCESS TERMS
Use of the Fuel Access Card(s) is subject to the following conditions:
Security
Customers must keep the security numbers associated with their cards confidential. Unauthorized purchases due to lost or stolen cards will be the Customer’s responsibility until NVP is notified. Notification must be made within 24 hours. The Customer is responsible for any fuel purchased before NVP is notified and disables the card.
Indemnity
Customer agrees to hold NVP harmless from all claims, liabilities, losses, or damages (including attorney’s fees) arising from the misuse of the Fuel Access Card(s) by the Customer or anyone else authorized by the Customer. This includes, but is not limited to, claims involving environmental damage, death, injury, property damage, and violation of hazardous material laws.
Default
Failure to make timely payments or violations of this Agreement may result in immediate cancellation of card privileges. NVP reserves the right to collect unpaid balances, charge interest, or pursue legal remedies without waiving other rights.
Address Changes
Customer must notify NVP in writing of any change in billing or mailing address.
LEGAL TERMS
This Agreement is governed by the laws of the State of California. Any legal action will take place in Napa County, California. NVP may recover legal costs, collection fees, and attorney’s fees if the Customer breaches the agreement.
